Acceptance of Agreement: By using our site, you are agreeing to comply with and be bound by the following terms of use. Indemnification

You agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.

Nontransferable

Your right to use the Site is not transferable. Any password or right given to you to obtain information or documents is not transferable and may only be used by you.

Governing Law

Disputes

If such negotiations are unsuccessful, either party may refer the dispute to mediation in accordance with the Institute of Arbitrators and Mediators Australia Mediation Rules. If the dispute remains unresolved after such mediation, either party may refer the dispute to arbitration in accordance with the Institute of Arbitrators and Mediators Australia Rules for the Conduct of Commercial Arbitrations. The arbitration shall be conducted in Melbourne, Victoria, Australia. The language of the arbitration shall be English.

Miscellaneous

This Agreement constitutes the entire agreement between you and us with respect to the Site. Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

Unenforceable provisions

If any provision of this Agreement is unlawful, void or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

Waiver

The failure of 1001catalogues.com to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Relationship of the Parties

Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party a partner, joint venture or employee of the other party.

No Third-Party Beneficiaries

This Agreement is for the benefit of the parties hereto and their successors and permitted assigns, and is not for the benefit of, nor may any provision hereof be enforced by, any other person.

Termination

We reserve the right, in our sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice.

Export Control
